How does Smart & A-kassa work?
We at Smart protect your security as an employee and always do our best to ensure that you have the best conditions for smooth communication with the A-kassan. It's important that you contact us before contacting A-kassan. We always do our best but cannot guarantee A-kassa's approval. What Smart can do is help you meet as many requirements as possible to achieve a working condition, greatly increasing your chances of getting support.
Remember to always sign a contract and enter into an employment agreement with Smart before you start assignments or start invoicing for your assignments!
To increase your chances of being covered by the social security systems, such as the A-kassa, it is important to be able to show that you are employed by Smart and not acting as an independent freelancer who invoices as an entrepreneur.
As a user or member, you will be employed by Smart. Legally speaking, Smart is your employer and handles administrative tasks such as contact with authorities, invoicing, salary payments and taxes. We are an employment cooperative for freelancers.
There are various criteria that may be relevant to the assessment of your right to A-kassa as a freelancer.
Below are some important factors that A-kassan takes into account when they determine whether you are considered an employee or an independent contractor, which entitles you to compensation.
The law states that you, as an employee or independent contractor, are characterized by the fact that you:

Only make your workforce available.

Performs or sells only a specific service or type of work.

Get paid for the assignment based on time consumption, e.g. per hour.

Does not have an active company.

Usually lacks a specific workplace for the business.

Is registered with Arbetsförmedlingen.
In other words, to qualify for compensation from the A-kassa, you as an employee should have minimal personal responsibility and be under the employer's control.
At Smart, we meet the legal requirement by:
1) That you make a pre-registration of assignments via email
2) That we make assignment agreements between Smart and your client
3) That we arrange an employment agreement with you before you start implementing projects with us
Therefore, be sure to pre-register your assignment before invoicing.
If you invoice without a contract and without an employment agreement with Smart, you can be counted as an independent freelancer.
According to the A-kassa, you have the right to an overall assessment. A-kassan may not give advance notice, but they are obliged to make an assessment based on actual circumstances when they examine whether you are entitled to compensation from the insurance.
